Terms of Service

1. Service Description

SrefMindForge is a tool that helps users optimize prompts for Midjourney by analyzing and suggesting SREF (style reference) codes. We do not generate images, host servers for image generation, or have any affiliation with Midjourney Inc.

2. Subscription & Billing

• Subscriptions renew automatically each month unless cancelled.
• Cancellation takes effect at the end of the current billing cycle.
• Pricing may change with 30 days' notice.
• Billing is handled by LemonSqueezy. Disputes should be directed to LemonSqueezy support.
• No refunds for partial months or after subscription cancellation, except as per our Refund Policy.

3. License & Usage

SrefMindForge grants you a limited, non-exclusive, non-transferable license to use the service for personal or commercial creative work only. You may not:

• Reverse-engineer, decompile, or attempt to extract the SREF database
• Sell access to the service or resell subscription codes
• Use automated scraping, bots, or API exploitation
• Share subscription accounts across multiple users
• Reproduce the platform's functionality or styling

4. User Responsibility

You are responsible for the prompts you generate using SrefMindForge. We are not liable for images generated by Midjourney, copyright issues, or misuse of the tool.

5. Limitation of Liability

To the fullest extent permitted by law, SrefMindForge is provided “as-is” and “as-available”. We are not liable for data loss, service interruptions, inaccurate SREF recommendations, image quality, or any indirect, incidental, or consequential damages.

6. No Warranty

We make no warranty that the service will be uninterrupted, error-free, or meet your specific needs. Use at your own risk.

7. Modifications & Termination

We may modify, suspend, or terminate the service at any time with or without notice. Continued use implies acceptance of updated terms.

8. Governing Law

These terms are governed by applicable law. Any disputes shall be resolved in the relevant jurisdiction.

Privacy Policy

1. Data Collection

We collect minimal data: license key (for subscription validation), browser metadata (User-Agent, IP for abuse detection only). Your prompts and search parameters are processed in your browser and never sent to our servers.

2. Where Data Is Stored

• Client-side: All processing happens in your browser. No data leaves your device unless you export.
• Local Archive (PRO): IndexedDB, 7-day auto-delete. You control retention.
• LemonSqueezy: Your subscription data (email, payment) is stored by LemonSqueezy. See their privacy policy.
• Our servers: We do NOT store prompts, filters, or search history server-side.

3. Cookies & Local Storage

We use localStorage and IndexedDB for session state and subscription status only. No third-party cookies, no Google Analytics, no tracking pixels.

4. Third-Party Services

• LemonSqueezy: Handles payments and subscription validation.
• MyMemory (translated.net): If your prompt idea is not in English, the text is sent to the MyMemory translation API to translate it. Only the prompt text is transmitted — no identifiers, no account data. If you write in English, nothing is sent.
• Netlify: Hosts the application.
• Midjourney: Not affiliated. Your Midjourney usage is governed by their terms.

5. GDPR & Data Rights

Since most data is processed client-side, you have full control. Clear your browser storage at any time. For LemonSqueezy data, contact LemonSqueezy directly. We retain no personal information server-side.

6. Contact & Changes

For privacy inquiries, contact us via email. Policy changes take effect immediately upon posting.

Refund Policy

1. Refund Eligibility

• Within 14 days of purchase: Full refund if the service is not as described
• Billing error: Duplicate charges or unauthorized transactions
• Service unavailability: If SrefMindForge is unavailable for more than 7 consecutive days

2. Non-Refundable Scenarios

• Change of mind after 14 days
• Partial refunds for partial months (subscriptions are monthly)
• After active service use (archive created, prompts generated)
• After subscription cancellation

3. How to Request a Refund

Contact us with your order ID and reason. We will respond within 5 business days. Refunds are processed by LemonSqueezy, typically appearing in 3–5 business days.

4. Subscription Cancellation

You can cancel your subscription anytime. Cancellation takes effect at the end of your current billing cycle. No pro-rata refunds are issued.

5. Chargeback & Disputes

If you initiate a chargeback without contacting us first, your account will be immediately suspended and may be terminated permanently.

Liability Disclaimer

1. Service “As-Is”

SrefMindForge is provided on an “as-is” and “as-available” basis. We make NO warranties regarding accuracy, completeness, reliability, or fitness for any particular purpose.

2. No Liability For Damages

To the maximum extent permitted by law, CIANOAI and SrefMindForge are not liable for any damages, including direct, indirect, incidental, or consequential damages, loss of profits, service interruption, poor image quality, copyright infringement, or third-party claims.

3. SREF Database Accuracy

The SREF database is for reference only. We do not guarantee that suggestions will produce desired results, that codes are current, or that style combinations will be visually coherent.

4. No Affiliation With Midjourney

We are NOT affiliated with, endorsed by, or associated with Midjourney Inc. Your use of Midjourney is governed by their terms. We are not responsible for image generation quality, SREF validity, copyright issues, or Midjourney's policy changes.

5. User Responsibility

You are solely responsible for prompts you generate, images created, copyright compliance, and adherence to Midjourney's terms and applicable law.

6. Data Loss & Security

We are not liable for loss of archive data due to browser cache clearing, device malfunction, or unauthorized access to your local storage or IndexedDB.

7. Limitation of Liability Cap

Our total liability shall not exceed the amount you paid in the last 12 months, or €10, whichever is lower.

8. Indemnification

You agree to indemnify and hold harmless CIANOAI from any claims, damages, or expenses arising from your use of SrefMindForge or violation of these terms.
